If a corresponding consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, insofar as the consent includes the storage of cookies or access to information in the user's terminal device (e.g., device fingerprinting) within the meaning of TDDDG. Consent can be revoked at any time.

Our host will only process your data to the extent necessary to fulfill its service obligations and follow our instructions regarding this data. As part of hosting, your data is processed on the basis of a Data Processing Agreement (DPA).

Note on Data Transfer to Third Countries That Are Not Secure Under Data Protection Law and Transfer to US Companies That Are Not DPF-Certified

We use, among other things, tools from companies based in third countries that are not secure under data protection law as well as US tools whose providers are not certified under the EU-US Data Privacy Framework (DPF). When these tools are active, your personal data may be transferred to these countries and processed there. We would like to point out that in third countries that are not secure under data protection law, no level of data protection comparable to the EU can be guaranteed.

We would like to point out that the USA as a secure third country generally has a level of data protection comparable to the EU. Data transfer to the USA is permitted if the recipient is certified under the „EU-US Data Privacy Framework“ (DPF) or has suitable additional guarantees. Information on transfers to third countries, including data recipients, can be found in this privacy policy.

Recipients of Personal Data

In the course of our business activities, we work with various external bodies. In some cases, it is also necessary to transfer personal data to these external bodies. We only pass on personal data to external bodies if this is necessary within the scope of fulfilling a contract, if we are legally obliged to do so (e.g., passing on data to tax authorities), if we have a legitimate interest pursuant to Art. 6(1)(f) GDPR in passing it on, or if another legal basis permits the transfer of data. When using processor service providers, we only pass on personal data of our customers on the basis of a valid contract for data processing. In the case of joint processing, a joint processing agreement is concluded.

Revocation of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The legality of data processing carried out until revocation remains unaffected by the revocation.

Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)

IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME, ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION, TO THE PROCESSING OF YOUR PERSONAL DATA; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR CONCERNED PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR PROCESSING THAT OVERRIDE YOUR INTERESTS, RIGHTS, AND FREEDOMS, OR PROCESSING SERVES TO ASSERT, EXERCISE, OR DEFEND LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

IF YOUR PERSONAL DATA ARE PROCESSED FOR DIRECT MARKETING PURPOSES, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of violations of the GDPR, data subjects have a right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged violation. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Right to Data Portability

You have the right to have data that we process automatically on the basis of your consent or in fulfillment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of data to another controller, this will only be done to the extent that it is technically feasible.

Information, Rectification, and Erasure

Within the framework of applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipient, and the purpose of data processing and, if necessary, a right to rectification or erasure of this data. You can contact us at any time regarding this and other questions on the subject of personal data.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you contest the accuracy of your personal data stored with us, we usually need time to verify this. For the duration of the audit, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to exercise, defend, or assert legal claims, you have the right to request the restriction of processing of your personal data instead of erasure.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the assertion, exercise, or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

For security reasons and to protect the transmission of confidential content, such as orders or inquiries that you send to us as the site operator, this site uses SSL or TLS encryption. Cookies

Our internet pages use so-called „cookies“. Cookies are small data packages and do not cause any damage to your end device. They are stored either temporarily for the duration of a session (session cookies) or permanently (permanent cookies) on your end device. Session cookies are automatically deleted at the end of your visit. Permanent cookies remain stored on your end device until you delete them yourself or automatic deletion takes place via your web browser.

Cookies can originate from us (first-party cookies) or from third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services of third-party companies within web pages (e.g., cookies for handling payment services).

Cookies have various functions. Numerous cookies are technically necessary, as certain website functions would not work without them (e.g., shopping cart function or displaying videos). Other cookies can be used to evaluate user behavior or for advertising purposes.

Cookies required to carry out the electronic communication process, to provide certain functions requested by you (e.g., for the shopping cart function), or to optimize the website (e.g., cookies for measuring web audience) (necessary cookies) are stored on the basis of Art. 6(1)(f) GDPR, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimized provision of its services. If consent to the storage of cookies and comparable recognition technologies has been requested, processing takes place exclusively on the basis of this consent (Art. 6(1)(a) GDPR and § 25(1) TDDDG); consent can be revoked at any time.

You can set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. Deactivating cookies may restrict the functionality of this website.

If other cookies and services are used on this website, you can find this in this privacy policy.

The data collected in this way will be stored until you request us to erase it, delete the Complianz cookie yourself, or the purpose for storing data no longer applies. Mandatory statutory retention requirements remain unaffected.

Complianz is used to obtain legally required consent for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Contact Form

If you send us inquiries via the contact form, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not pass on this data without your consent.

The processing of this data takes place on the basis of Art. 6(1)(b) GDPR if your request is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective processing of requests addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this was requested; consent can be revoked at any time.

The data entered by you in the contact form will remain with us until you request us to delete it, revoke your consent to storage, or the purpose for data storage no longer applies (e.g., after processing your request has been completed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Personal data additionally collected during the sending process (IP address, date/time) will be deleted after 7 days at the latest.

Request by E-Mail, Telephone, or Fax

If you contact us by e-mail, telephone, or fax, your request, including all personal data resulting from it (name, request), will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

The processing of this data takes place on the basis of Art. 6(1)(b) GDPR if your request is related to the fulfillment of a contract or is necessary to carry out pre-contractual measures. Google Fonts (Local Hosting)

This page uses so-called Google Fonts provided by Google for the uniform display of fonts. Google Fonts are installed locally. A connection to Google servers does not take place.

Further information about Google Fonts can be found at https://developers.google.com/fonts/faq and in Google's privacy policy: https://policies.google.com/privacy?hl=en.

Google Maps

To use the functions of Google Maps, it is necessary to store your IP address. This information is usually transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transmission. When Google Maps is activated, Google can use Google Fonts for the purpose of uniform display of fonts. This represents a legitimate interest within the meaning of Art. 6(1)(f) GDPR. Google reCAPTCHA

We use „Google reCAPTCHA“ (hereinafter „reCAPTCHA“) on this website. Provider is Google Ireland Limited („Google“), Gordon House, Barrow Street, Dublin 4, Ireland.

The purpose of reCAPTCHA is to check whether data entry on this website (e.g., in a contact form) is made by a human or by an automated program. For this purpose, reCAPTCHA analyzes the behavior of the website visitor based on various characteristics. This analysis starts automatically as soon as the website visitor enters the website. For analysis, reCAPTCHA evaluates various information (e.g., IP address, duration of the website visitor's stay on the website, or mouse movements made by the user). Data collected during analysis is forwarded to Google.

reCAPTCHA analyses run completely in the background. Website visitors are not notified that an analysis is taking place.

Storage and analysis of data take place on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in protecting its web offers from abusive automated spying and from SPAM.

The use of Wordfence is based on Art. 6(1)(f) GDPR. The website operator has a legitimate interest in as effective protection as possible of its website against cyberattacks.

Data transfer to the USA is based on standard contractual clauses of the EU Commission. Details can be found here: https://www.wordfence.com/help/general-data-protection-regulation/.

6. Custom Services

Handling Applicant Data

We offer you the opportunity to apply to us (e.g., by e-mail, post, or via online application form). In the following, we inform you about the scope, purpose, and use of your personal data collected as part of the application process. We assure that the collection, processing, and use of your data takes place in accordance with applicable data protection law and all other statutory provisions and that your data will be treated with strict confidentiality.

Scope and Purpose of Data Collection

If you send us an application, we process your associated personal data (e.g., contact and communication data, application documents, notes taken during job interviews, etc.) to the extent necessary to decide on establishing an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation), and – if you have given consent – Art. 6(1)(a) GDPR. Consent can be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems on the basis of § 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

As part of the application process, we may also conduct internet research regarding your person. This primarily includes Google search, LinkedIn, and Xing. The legal basis for this type of processing is our legitimate interest in obtaining an overall impression of publicly available information about you pursuant to Art. 6(1)(f) GDPR.

Data Retention Period

If we cannot make you a job offer, you reject a job offer, or withdraw your application, we reserve the right to retain the data transmitted by you on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and physical application documents destroyed. Storage serves in particular for evidence purposes in the event of a legal dispute. If it is evident that the data will be required after the 6-month period has expired (e.g., due to an impending or pending legal dispute), deletion will only take place when the purpose for further storage no longer applies.

Longer storage can also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations prevent deletion.

Inclusion in the Applicant Pool

If we do not make you a job offer, there may be an opportunity to include you in our applicant pool. In the event of inclusion, all documents and details from the application will be transferred to the applicant pool in order to contact you in the event of suitable vacancies.

Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6(1)(a) GDPR). Granting consent is voluntary and has no relation to the ongoing application process. The data subject can revoke consent at any time. In this case, data from the applicant pool will be irrevocably deleted, unless there are statutory retention reasons.

Data from the applicant pool will be irrevocably deleted two years after consent is granted at the latest.
